Tier 1 Post-Study Worker

The Tier 1 (Post-Study Work) of the Points Based System was introduced on 30 June 2008.

This category allows the most able international graduates, who have studied in the UK, to work in the UK for a period of two years, without having a sponsor for the length of their Tier 1 (Post-Study Work) leave. The aim of this category is to provide international graduates with a bridge to highly skilled or skilled work in the UK and individuals with leave in this category will be expected to switch into another part of the points-based system as soon as they are able to do so.

How do I qualify for this permit? 

To qualify to apply under the points-based system under the Tier 1 Post-Study Worker scheme, you must score at least 75 points for attributes. Applicants will also need to meet the English language requirement (10 points) and the separate requirement for maintenance (10 points).

Points can be scored as follows: 

Tier 1 (Post-Study Worker) - Attributes

 
 
 

PLEASE NOTE: You have to score at least 75 points for your attributes

The applicant has been awarded:
1) a United Kingdom recognised bachelor's or postgraduate degree;
2) a United Kingdom postgraduate certificate or diploma; or
3) a higher national diploma (HND) from a Scottish institution.

The applicant studied for the award at a UK institution that is a UK recognised or listed body, or holds a sponsor licence under Tier 4 of the points-based system

OR

If the applicant is claiming points for having been awarded an HND from a Scottish Institution: the HND must have been studied at a Scottish publicly funded institution of further or higher education,
or at a Scottish bona fide private education institution which maintains satisfactory records of enrolment and attendance.

The applicant's periods of study and/or research towards the eligible award were undertaken while in the United Kingdom with entry clearance, leave to enter or leave to remain as a:

1) student (this includes student, student nurse, student re-sitting examinations, student writing up a thesis); or
2) dependant of someone with leave in any category permitting the admittance of dependants.

The applicant made the application for entry clearance or leave  to remain as a Tier 1 (Post-Study Work) migrant within 12 months  of obtaining the relevant qualification.

Tier 1 (Post-Study Work) – English Language

 
 
 

You can claim 10 points under this category, as follows

Tier 1 (Post-Study Work) applicants who meet the pass-mark of 75 points for attributes will satisfy the English language requirement.

Tier 1 (Post-Study Work) – Maintenance


You can claim 10 points under this category as follows
 

Applicants for leave to remain in the UK must have £800 of available funds.
Applicants for entry clearance to come into the UK must have £2,800 available funds.

Some Rules and Restrictions on the Tier 1 Post-Study Worker:

  • Successful applicants in this category will receive a single grant of leave for two years.
  • No further grant of leave will be made under Tier 1 (Post-study Work).
  • You will have no recourse to public funds.
  • You may not be employed as a doctor in training.

Does this visa lead to indefinite leave to remain?

No, time spend in the Tier 1 (Post-study Work) category does not count towards eligibility to apply for indefinite leave to remain.
